Terms of Service — CalmArms

1. Acceptance of Terms

By accessing or using CalmArms (the "Service"), including our mobile application and website at calmarms.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

CalmArms is a mobile fitness application that uses on-device machine learning to analyze and grade weightlifting form in real time. The Service includes:

Real-time pose detection and form grading
Automatic rep counting
Workout history and progress tracking
Gamification features (achievements, streaks, leaderboards)
A companion website for viewing progress and legal documents

3. Account Registration

To use certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

You must be at least 13 years old to create an account and use the Service.

4. Subscriptions and Payments

CalmArms offers a free trial experience (one set) and paid subscription plans ("CalmArms Pro"). By subscribing, you agree to the following:

Subscriptions are billed through the Apple App Store or Google Play Store
Subscriptions automatically renew unless canceled at least 24 hours before the renewal date
You can manage and cancel subscriptions through your device's app store settings
Refunds are handled by Apple or Google according to their respective refund policies
Promo codes may be offered for free or discounted access, subject to their specific terms

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to reverse-engineer, decompile, or extract source code from the application
Interfere with or disrupt the Service or its infrastructure
Create multiple accounts to abuse promotional offers
Share, sell, or transfer your account credentials
Use the Service in a way that could harm other users

6. Health Disclaimer

CalmArms is not a medical device and does not provide medical advice. The form grading and feedback provided by the Service are for informational and educational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.

Always consult a qualified healthcare provider before beginning any exercise program. If you experience pain or discomfort during exercise, stop immediately and seek medical attention.

CalmArms makes no guarantee that following our form feedback will prevent injury. You exercise at your own risk.

7. Intellectual Property

The Service, including its design, code, algorithms, content, and branding, is owned by CalmArms and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, CalmArms and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, injury, or lost profits, arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the form grading will be 100% accurate, that the Service will be uninterrupted or error-free, or that defects will be corrected.

10. Account Termination

You may delete your account at any time through the Data & Privacy screen in the app. We may also terminate or suspend your account if you violate these Terms, with or without notice.

Upon termination, your right to use the Service ceases immediately. Data deletion follows the process described in our Privacy Policy.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
